Terms of Service

These Terms of Service ("Terms") govern your use of the Anyone's Guess mobile applications and website at https://anyonesguess.app (collectively, the "Service"), operated by Ixian Labs ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Anyone's Guess is a sports prediction game for entertainment. You predict match scores and outcomes, compete in public and private leagues, climb ELO and ranked standings, and earn points. The Service is provided on iOS, Android, and the web.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account. You may sign in using email and password, Google Sign-In, or Sign in with Apple.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Cheat, exploit bugs, manipulate scoring, or use automated tools to gain an unfair advantage
• Create multiple or fake accounts to abuse rankings, rewards, or leagues
• Harass, abuse, impersonate, or harm other users
• Upload content that is illegal, offensive, infringing, or otherwise objectionable
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems

We may suspend or terminate accounts that violate these rules.

4. Virtual Currency ("Tickets")

The Service includes a virtual currency called "tickets." Tickets are a limited, revocable license to use a feature of the Service and:

• Have no monetary or cash value and are not real money or any equivalent
• Are non-transferable and cannot be sold, traded, or exchanged outside the Service
• Cannot be redeemed for cash or any real-world goods, services, or prizes
• Are non-refundable except where a refund is required by applicable law

We may modify, manage, or remove tickets and ticket-based features at any time. You do not own tickets, and any unused tickets are forfeited if your account is terminated.

5. Purchases and Subscriptions

You may purchase digital items and subscriptions through the Service. On mobile, purchases are processed by the Apple App Store or Google Play through RevenueCat. On the web, purchases are processed by Stripe.

We currently offer:

• Pro — an auto-renewing subscription at $1.99 per month
• World Cup Pass — a one-time purchase at $2.99

Subscriptions automatically renew for the same period at the then-current price unless cancelled before the end of the current billing period. You can manage or cancel a subscription at any time through your Apple App Store account settings, your Google Play account settings, or the Stripe customer portal, depending on where you subscribed. Except where required by law or by the applicable app store's policies, payments are non-refundable. Prices may change with notice as required by applicable law and store policies.

6. No Gambling; Games of Skill

Anyone's Guess is a game of skill provided for entertainment only. The Service does not offer gambling, betting, wagering, or real-money prizes. No purchase or payment improves your odds of winning predictions, and no in-game points, rankings, or tickets can be exchanged for money or anything of monetary value.

7. Match Data

Fixture, schedule, and live result data is provided by third-party sources, including football-data.org. We strive for accuracy but do not guarantee that match data is error-free or always up to date, and scoring is based on the data available to us.

8. Intellectual Property

The Service, including its software, design, branding, text, and graphics, is owned by Ixian Labs or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted. Team names, crests, and competition marks are the property of their respective owners and are used for identification purposes only.

9. User Content

You retain ownership of content you submit, such as your display name and profile photo. By submitting content, you grant us a worldwide, royalty-free license to host, store, and display that content as needed to operate the Service. You are responsible for ensuring you have the rights to any content you upload.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that match data will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Ixian Labs and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the extent liability cannot be excluded, our total liability for any claim arising out of these Terms or the Service is limited to the greater of the amount you paid us in the twelve months before the claim or USD 50.

12. Termination

You may stop using the Service and delete your account at any time from within the app under Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends and any unused virtual currency is forfeited. Sections that by their nature should survive termination will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator resides, without regard to its conflict-of-law rules. Any disputes arising from these Terms or the Service are subject to the exclusive jurisdiction of the courts located in that jurisdiction, except where applicable consumer protection law provides otherwise.
